The court system in California can suspend your driver’s license after a conviction for driving under the influence (DUI). This can be a significant problem, as many drivers need to operate a vehicle to get to work.
Fortunately, you may be allowed to drive to and from work during a license suspension for a DUI in California if you secure a restricted license. The team at the Simmrin Law Group can help you focus on the steps to get a restricted license. Get more information by calling (310) 896-2723.
You Can Drive with an IID-Restricted License After a DUI
In the year 2019, California adopted a statewide ignition interlock device (IID) program for drivers convicted of a DUI. This means that most drivers in California are required to install an IID on their vehicle after a DUI conviction. Once your IID is installed, you can apply for a restricted license by bringing the Department of Motor Vehicles (DMV):
- Proof that you completed any required DUI programs
- Proof that you acquired SR-22 Insurance
- A completed Verification of Installation Ignition Interlock form (DL 920)
- Payment for reissue and restriction fees
After the DMV approves your request for an IID-restricted license, you can operate your vehicle freely in California. You can drive to and from work as well as to any other locations you wish to visit.

Other Options for a Restricted License Following a DUI
Note that not all drivers in California are required to install an IID after a conviction. Some first-time DUI offenders may opt not to install an IID. Instead, they may apply for a general restricted license by:
- Enrolling in a DUI program and getting proof of enrollment
- Acquiring an SR-22 form to show proof of insurance
- Visiting the DMV with proof of enrollment and proof of insurance
- Paying any relevant application fees
A general restricted license only guarantees drivers the right to travel court-ordered programs. Some of these licenses also allow drivers to go to and from work, but it is not guaranteed as it would be with an IID restricted license.

Driving at Work Following a DUI Conviction in California
You may be required to drive while working, depending upon your job. If you are driving a company vehicle, this can be complicated by a DUI arrest. If you have an IID-restricted license, you are only supposed to drive vehicles that have an IID installed.
However, your employer may apply for an Employer’s Vehicle exemption. This exemption allows you to drive a work vehicle without an IID. You will need to fill out a Notice to Employers Ignition Restriction (DL 923) form to secure the exemption.
You should be aware that not all employers will allow you to continue operating a company vehicle after a DUI conviction. In fact, employers in California may choose to terminate your employment after a DUI conviction, especially if you are required to do a lot of driving in the scope of your job.
DUI Convictions and Restrictions on Commercial Driver’s Licenses
Commercial drivers cannot use their license to drive to and from work after a DUI conviction. DUI convictions in California lead to a one-year license suspension for a commercial driver’s license (CDL), in which time drivers are not permitted to operate a commercial vehicle at all.
A subsequent DUI by a commercial driver will lead to the lifelong revocation of their CDL. Note that commercial drivers may still be allowed to operate non-commercial vehicles after a DUI, they will just lose their ability to operate commercial vehicles.
As you can see, a DUI conviction can have serious impacts on your ability to get to-and-from work and to complete your job. Get help handling DUI accusations before you are convicted by contacting the Simmrin Law Group.
